Is a CO₂ Gun Legal in India?
What the Arms Rules 2016 actually say about CO₂ air pistols — licence, dealers, age, carrying and self-defence — with the sources.

Quick answer
Yes. A CO₂ air gun of .177 calibre (4.5 mm) producing under 20 joules needs no arms licence in India under the Arms Rules 2016. It is still regulated: it can only be sold by a licensed air-weapon dealer who takes your ID and address proof, sellers sell only to adults, and pointing, brandishing or injuring someone with it can be an offence under the Bharatiya Nyaya Sanhita.
What the Arms Rules 2016 say
The Ministry of Home Affairs’ own FAQ on the Arms Rules 2016 splits air weapons into two classes (Category III(f) of Schedule I):

Is your CO₂ pistol under the limit?
Almost certainly. A .177 CO₂ pistol produces roughly 2–4 joules — a fifth or less of the 20-joule line.

What “no licence” does not cover
- Brandishing: showing or pointing any realistic pistol to frighten someone can be criminal intimidation (BNS ss. 351–352).
- Injury: hurting someone with an air gun can be treated as voluntarily causing hurt by a dangerous weapon (BNS s. 118); grievous hurt, such as loss of an eye, is punished far more severely.
- Negligence: careless use that injures someone can be charged under BNS s. 125.
- Wildlife: shooting birds or animals is an offence under the Wildlife (Protection) Act 1972.
- Where you shoot: only on your own property with a safe backstop, or at a range — never towards a public place.
Can a woman keep a CO₂ pistol for self-defence?
This is the question Khushboo Patani’s September 2026 video raised. Owning one is legal. The right of private defence (BNS ss. 34–44) permits proportionate force against a real, imminent threat, whatever is to hand. But a .177 CO₂ pistol is a deterrent and a training tool, not a stopping weapon, and several military veterans quoted in the press warned that an untrained person drawing a gun-shaped object can escalate danger. Do state rules differ?
The Arms Rules are central and apply in every state, so the 20-joule / .177 line is the same everywhere. A few police departments have asked owners to voluntarily intimate the local police station. How to buy a CO₂ pistol legally
- Buy from the manufacturer or an authorised air-weapon dealer — not a toy shop or an anonymous listing.
- Expect to give photo ID and address proof. A seller who does not ask is cutting corners.
- Get a GST invoice that names the maker and states calibre (.177) and energy (under 20 J).
- Keep the warranty card and invoice with the gun.

Is a CO₂ gun legal in India?
Yes. A CO₂ air gun of .177 calibre (4.5 mm) with muzzle energy under 20 joules is legal to buy and own in India without an arms licence. Under the Arms Rules 2016, only air weapons above 20 joules and/or with a bore larger than .177 inch need a licence. Legal CO₂ guns must still be sold by a licensed air-weapon dealer who takes the buyer’s identity and residence proof.
Do I need a licence for a CO₂ air pistol?
Not for a .177 CO₂ air pistol under 20 joules — which covers almost every CO₂ pistol sold in India, including the Umarex Glock 17 Gen 4 from Khushboo Patani’s video and the Camstar Star RX Gen 3. A .22 (5.5 mm) or higher-power air weapon does need a licence and counts toward the three-firearm limit.
Can I carry a CO₂ pistol in public in India?
There is no carry licence for a sub-20-joule air pistol because it is outside licensing, but carrying it openly or showing it is risky and can be illegal. Brandishing or pointing it to frighten someone can be criminal intimidation under BNS Sections 351–352, and police cannot tell a realistic replica from a firearm. If you transport it, keep it unloaded, cased and out of sight.
Can I use a CO₂ gun for self-defence?
The right of private defence (BNS Sections 34–44) allows proportionate force against a real, imminent threat, and it applies whatever you use. It does not make an air gun a lawful weapon to carry or display in advance. Injuring someone outside private defence can be charged as hurt by a dangerous weapon (BNS Section 118). A .177 CO₂ pistol is also physically unlikely to stop a determined attacker.
What is the minimum age to buy a CO₂ air gun in India?
Sellers sell only to adults (18+) against photo ID and address proof. The Arms Rules allow people aged 12 to 21 to use permissible arms for training only under the direct supervision of an adult instructor or licensee, so a teenager can learn under supervision but should not be the buyer or sole user.
Can I buy a CO₂ pistol online legally?
Yes, from a seller entitled to sell air weapons who collects your ID and address proof. The law requires sale through a licensed air-weapon dealer, not anonymously and not through a toy shop. Buy from the manufacturer or an authorised dealer, and insist on a GST invoice stating the calibre and energy.
Can I shoot birds with a CO₂ air gun?
No. Hunting, killing or capturing wild birds or animals — including pigeons and sparrows — with an air gun is an offence under the Wildlife (Protection) Act 1972. Use air guns only on paper targets and pellet traps.
